Australian Dairy Mark
Rules of Use

Category One

A licence will be granted for the use of the Australian Dairy Mark for dairy products which satisfy the following criteria:

  • At least 90% of the dairy ingredients used in manufacture are of Australian origin.
  • At least 75% of the factory or works cost of the finished packaged product is attributable to the following expenses:
    • Materials and ingredients of Australian origin
    • Wages and factory overheads incurred in Australia
  • Application of the Dairy Mark to the product would not constitute misleading or deceptive conduct within the meaning of the Trade Practices Act.
  • The Applicant complies with the terms and conditions under which the licence is granted.
  • The granting of the licence will not bring the Dairy Mark into disrepute.

Category Two

A licence will be granted for use of the Australian Dairy Mark on food products which contain dairy ingredients which satisfy the following criteria.

  • The dairy ingredient component of the food product complies with the requirements of Category One.
  • The dairy ingredients utilised are of Australian origin and conform with relevant Australian Food Standards.
  • The product is not a substitute for a dairy product and is not a specifically excluded product.
  • The use of the Dairy Mark is intended to relate to and act as an endorsement of the dairy ingredients only, not of the whole product.

Category Three

If a product meets all the Category One or Category Two criteria except the 90% Australian dairy requirement, a licence may still be granted, providing there are special considerations underlying the failure to achieve the 90% requirement, such as:

  • impracticality of sourcing Australian materials.
  • it can be demonstrated that efforts were made to replace imported materials with cost competitive Australian materials.

If a product meets all the Category One or Category Two criteria except the 75% total Australian requirement, a licence may still be granted, providing there are special considerations underlying the failure to achieve the 75% requirement, such as:

  •  impracticality of sourcing Australian materials.
  •  It can be demonstrated that efforts were made to replace imported materials with cost competitive Australian materials.

Products produced from the milk of animals other than cows are specifically excluded from displaying the Australian Dairy Mark.

The Australian Dairy Mark enables consumers to quickly and easily recognise that products bearing the symbol are:

(a) Australian
(b) real dairy products and not dairy substitutes
(c) pure and natural
(d) good for you
